No one disclosed this to Chapman. In fact, Cummins provided Chapman with a warranty despite knowledge that the engine could not perform in that configuration. When Chapman tried to use the skidder, it started to overheat and ceased functioning. Chapman called Cummins to repair the engine in the skidder under the warranty.
