Because the dentist is not a physician, it is malpractice for a dentist to tell the patient to stop taking an anticoagulant or antiplatelet. Similarly, it is medical malpractice if the dentist fails to consult with the patient's physician regarding the proposed procedure and risk of bleeding. It may also be malpractice if the physician inappropriately tells a patient to stop their medication for a relatively minor dental procedure with a minimal risk of bleeding. This is the first time the Texas Supreme Court has considered a case that presents the applicability of the learned intermediary doctrine within the context of prescription drug products-liability cases. The Texas Supreme Court held that because patients can obtain prescription drugs only through their prescribing physician or another authorized intermediary and because the learned intermediary' is best suited to weigh the patient's individual needs in conjunction with the risks and benefits of the prescription drug, the learned intermediary doctrine applies and limits the drug manufacturer's duty to warn only the prescribing physician. The Texas Supreme Court further held that the learned intermediary doctrine is not a common-law affirmative defense, which would shift the burden on drug manufacturers to plead, prove and request jury findings on the doctrine. Rather, the Texas Supreme Court held that it is more akin to a common-law rule. The Texas Supreme Court held that Hamilton had the burden to prove that Centocor's warning to the prescribing doctors was inadequate. Attorney For Medical Negligence Cisco TX Plaintiff also refers us to Turner v. Mellon (1953) 41 Cal.2d 45, 257 P.2d 15 (Turner ). In Turner, again the question was whether the defendant was liable as one who had assisted in bringing about a police officer's unjustified arrest. Mellon, a Western Union employee, had been robbed several times at his place of employment. He observed plaintiff Turner behaving suspiciously outside his office, telephoned the police, and stated his suspicion that Turner was the robber. Mellon tentatively identified Turner as such to the police. Turner was arrested, but soon was released. We noted that an individual is not liable for false imprisonment unless he or she has taken some active part in bringing about the unlawful arrest' by the police. There is no liability if, acting in good faith,' he or she simply furnishes information leading to an arrest. (Id. at p. 48, 257 P.2d 15.) Although not confronted with a case in which bad faith was alleged, we pointed out how unjust and injurious to the public interest it would be to impose liability for honest mistakes. We concluded that the defendant, though he had given mistaken information leading to the arrest, had not taken an active part in bringing about the unlawful arrest.' (Ibid.) Defendant's conduct as a matter of law, did not amount to participation in the arrest. (Id. at p. 49, 257 P.2d 15.) Actual Case: $200,000 settlement during a damages only Kings County trial for a 34 year old in a car accident who sustained back injuries. In some medical malpractice cases, the hospital or medical professional is not responsible for a patient's injury or wrongful death. If the nerve damage is permanent and if it is not a known risk of implants, you may have a case. But these are costly cases to prove (expert fees etc.), so many times they are not worth it. Parents complained that they were not informed that the counselling would be delayed for the inauguration of the placement cell. "I reached the venue at 6 am," Abbas Khan, a parent, said. "We are tired. We are also frustrated by the attitude of the officials. Many parents and candidates have been standing for hours due to lack of sufficient seats in the waiting hall," he said. As has been said: "Some were partly right, all were in the wrong." Two colleges grew out of this difference. The offshoot, the Cleveland Medical College, after a year, built a college on Bolivar Street, and about the same time the other division, styled the Cleveland Homeopathic Medical College, opened its new building on Huron Street. The next year its name was changed to the Cleveland University of Medicine and Surgery. The building on Huron was built from funds donated, at a cost of $50,000. The building was under the direction of Dr. Stanley Hall. Pedestrian struck by vehicle, ankle fracture requiring surgery ( Albert H. Lechner ) Attorney David Hodge, along with Vance McCrary of The Gardner Firm in Mobile and James (Jimmy) Seale of Greensboro tried and received a jury verdict in the Circuit Court of Hale County, Alabama which totaled $17,559,700. Hodge represented Charles Miller Chapman against Cummins, Inc. and Bama Logging Equipment Company, Inc. Chapman made claims of Fraud and Breach of Warranty involving the sale of a skidder- a large piece of equipment used to drag cut logs from the woods to a loading area where they can be loaded onto a log trailer. Chapman visited the Bama Logging Equipment Company, and he allegedly was sold the defective skidder as a demo unit. Unbeknownst to Chapman, the log skidder he had purchased was, in fact, a one-of-a-kind developmental prototype that had an engine manufactured and produced by Cummins. Cummins had internally determined the engine would not work in this prototype. Chapman alleged that Cummins knew the engine was not suitable for use in this piece of equipment and even before the machine was assembled, Cummins, determined the Tier II engine would not work in this configuration. No one disclosed this to Chapman. In fact, Cummins provided Chapman with a warranty despite knowledge that the engine could not perform in that configuration. When Chapman tried to use the skidder, it started to overheat and ceased functioning. Chapman called Cummins to repair the engine in the skidder under the warranty. Attempts to repair the prototype skidder were unsuccessful, and Chapman filed suit. This case was tried by Morris, King & Hodge, P.C. attorney David Hodge of Huntsville, Alabama who can be reached at dhodge@ or toll free 888-321-8353. Attorney For Medical Negligence Cisco Texas 30708 03/10/2016 - Virginia lawmakers pass 'landmark' medical marijuana bill Background With the advent of the direct-acting antiviral agents (DAAs), significant drug-drug interaction (DDI) potential now exists for patients treated for chronic hepatitis C virus (HCV) infection. However, little is known about how often patients with HCV use medications that may interact with newer HCV treatments, especially those with CYP3A DDI potential. Methods Using a large United States commercial insurance database, medication use and comorbidity burden was examined among adult patients with a chronic HCV diagnosis from 2006-2010. Medications were examined by total number of prescription claims, proportion of patients exposed, and DDI potential with prototypical CYP3A DAAs, boceprevir and telaprevir, for which data were available. Results Patient comorbidity burden was high and increased over the study period. Medication use was investigated in 53,461 patients with chronic HCV. Twenty-one (53%) of the top 40 most utilized medications were classified as having interaction potential, with 62% of patients received at least one of the top 22 interacting medications by exposure. Of these, 59% and 41% were listed in a common DDI resource but not in medication prescribing information, 77% and 77% had not been investigated in DDI studies, 32% and 27% did not have clear recommendations for DDI management, and only 14% and 23% carried a recommendation to avoid coadministration for boceprevir and telaprevir, respectively. Conclusion Practitioners may expect a medication with CYP3A DDI potential in two-thirds of patients with HCV and almost one-half of the most frequently used medications. However, DDI potential may not be reflected in prescribing information. PMID:25014625 The overall average patient rating of Dr. Paul Schwarz is Excellent.
